Nex Hosting Terms and Conditions

Welcome to Nex Hosting. These Terms and Conditions (the "Terms") govern the access, contracting and use of our hosting services, in particular Minecraft Hosting, offered through our website, control panel and any other related platform.

By creating an account, signing in, purchasing a hosting plan or using our services, you (the "Client") acknowledge that you have read, understood and accepted these Terms in full. If you do not agree with any part of these Terms, you must refrain from contracting or using our services.

1. Who we are

Nex Hosting is a hosting provider specialized in offering optimized plans for Minecraft servers. Our mission is to make it easy for users to create, manage and enjoy private Minecraft servers simply and efficiently.

We are not owners, developers, nor affiliated in any way with Mojang Studios, Microsoft Corporation nor the creators of Minecraft. Nex Hosting acts solely as a provider of technological infrastructure.

2. Services

Nex Hosting provides virtual servers optimized for hosting Minecraft instances.

The Client has full control over the configuration of their server within technical and legal limits.

Service availability depends on technical, maintenance and third-party (infrastructure providers) factors; therefore 100% uptime is not guaranteed, though we strive for maximum stability.

3. Terms of use

By contracting or using our services, the Client agrees that:

• They will be solely responsible for the content, configuration, modifications and use of their Minecraft server.
• They may not use our services for illegal, fraudulent, malicious purposes or in ways that infringe third-party rights.

Use of our servers is not permitted for:

• Distribution of malicious software.
• DDoS attacks or activities compromising external networks.
• Illegal content under applicable law.

Nex Hosting does not monitor server content and is not responsible for what Clients or users do within them.

4. Refunds and cancellations

By purchasing a server or subscription from Nex Hosting, the Client accepts the creation of a recurring subscription that renews automatically every month or according to the billing period selected at checkout until it is cancelled.

Subscription renewals are not refundable. Refunds also do not apply to new purchases unless the product does not work correctly or a refund is required by law.

If the Client believes the product is not working correctly, they must contact Nex Hosting so the case can be reviewed. If an actual service failure is confirmed, Nex Hosting may approve a refund or provide the appropriate remedy.

In the event of a chargeback, regardless of the payment method, Nex Hosting will immediately remove the contracted server and may take further measures it deems necessary.

If a payment is placed on hold, disputed, under antifraud/manual review, chargeback process, frozen, bank-blocked or if for any reason funds are not effectively credited to Nex Hosting’s account, Nex Hosting may suspend, delay provisioning or withhold delivery of any service/item until definitive confirmation of funds. Time elapsed during the hold does not generate extensions, uptime guarantees, or compensation.

The user acknowledges and accepts that, by initiating the provision of the digital service immediately and with their express consent, they waive their right of withdrawal in accordance with applicable regulations.

5. Disclaimer

Nex Hosting is not responsible for the use the Client or third parties make of the contracted servers.

All activity performed on the contracted servers is the sole responsibility of the Client.

The Client understands and accepts that Nex Hosting is completely detached from any consequence derived from:

• Legal or contractual breaches committed by the Client.
• Technical issues or data loss caused by configurations external to the base service.
• The use of mods, plugins, or other unofficial add-ons.

6. Relationship with Minecraft and acceptance of the EULA

Minecraft is a product owned by Mojang Studios and Microsoft Corporation.

By creating a server with Nex Hosting, the Client agrees to comply with the Minecraft EULA (End User License Agreement) available at: https://www.minecraft.net/eula.

Nex Hosting has no direct relationship with Mojang/Microsoft and acts solely as a technical infrastructure provider.

The Client is responsible for ensuring that their use of Minecraft complies with the EULA provisions and any other agreement established by Mojang/Microsoft.

7. Limitation of warranties

Nex Hosting does not warrant the services to be error-free, uninterrupted or vulnerability-free. Services are provided "as is" and "as available".

8. Limitation of liability

To the maximum extent permitted by law:

• Nex Hosting will not be liable for direct, indirect, incidental, special or consequential losses arising from the use or inability to use the service.
• Total liability of Nex Hosting will never exceed the amount paid by the Client in the last 30 days prior to the claim.

9. Modifications of the Terms

Nex Hosting may modify these Terms at any time. Changes will be notified through our website or by email. Continued use after notification implies acceptance of the new Terms.

10. Governing law and jurisdiction

These Terms are governed by Spanish and European law. Any dispute shall be submitted to the competent courts in the jurisdiction of Nex Hosting's registered office, unless otherwise required by law.

11. Acceptance

• These Terms and Conditions.
• That purchasing a server or subscription creates a recurring monthly charge or the charge for the selected billing period.
• That renewals are non-refundable and refunds only apply if the product does not work correctly or if required by law.
• Acceptance of the Minecraft EULA.
